ACCEPTANCE AND PURPOSE
By using the Platform, the User agrees to these Terms and the Privacy Policy. Commizzion is not a betting operator; it is a B2B platform for campaign management, attribution, reporting, and payments.
RULES FOR ADVERTISING GAMBLING
Only operators authorized by SPA/MF; targeting minors is prohibited; +18 and responsible gambling notices; transparency with influencers; blocks if they do not prove compliance (.bet.br when applicable).
PROHIBITED SERVICES AND CONDUCT
Services: campaign management, attribution/reporting, publisher settlements, advertising compliance. Prohibited: fraud/invalid traffic, interfering with security, violating IP or laws, circumventing Commizzion.
PAYMENTS AND TAXATION
The Operator pays Commizzion; Commizzion settles with the Publisher net of withholdings and taxes, within 15 business days from confirmation by the Operator. NF-e where applicable.
FRAUD/CHARGEBACKS AND PROCESS
Payments/links may be suspended based on objective evidence; 5 business days for appeals; compensation/withholding up to 180 days if confirmed.
PRIVACY, COOKIES AND NOTICE & TAKEDOWN
LGPD roles; 2-level cookie banner; logs compliant with Marco Civil; possibility of de-indexing upon valid notification.
LIABILITY, TERMINATION AND DISPUTES
Limitation of liability: amounts paid to the Publisher in the last 3 months (except in cases of fraud/gross negligence). Termination: notice of termination (15 days) or breach of contract (5 days' notice). Arbitration CAM-CCBC (São Paulo) for B2B; CDC/consumer forum if applicable.
TERMS AND CONDITIONS – AFFILIATE/COMMISSION PROGRAM
PARTS AND NATURE
Commizzion (INLAZE LTDA., CNPJ 61.239.904/0001-69) and the approved Publisher. Marketplace/management; not a betting operator.
DEFINITIONS
Attribution, Valid CPA, Invalid Traffic (bots, self-referral, manipulation, VPN/proxy, impersonation).
ONBOARDING AND COMPLIANCE
Reasonable KYB/KYC; AML/CFT and sanctions; SPA/MF authorized operators only.
ADVERTISING
+18 warnings; responsible gaming; transparency with influencers; geo-restrictions; creative pre-approval and automatic blocks if it violates the rules.
ATTRIBUTION/VALIDATION/REPORTS
Commercial Annex windows; reconciliation with Operator sources; evidence (logs, device, IP).
PAYMENTS
D+15 business days net of withholdings; NF-e where applicable; Publisher's tax documentation.
SETTINGS/CHARGEBACKS
Compensation up to 180 days for invalidations/fraud.
INVALID TRAFFIC – PROCESS
Objective evidence → suspension; 5 days for appeal; rejection/retention; reiteration → termination.
NO AVOIDANCE
24 months with a penalty of 20% on income generated with the evaded Operator.
IP/TRADEMARKS, CONFIDENTIALITY AND DATA
Publisher's intellectual property is retained; limited license. Data processing in accordance with the Policy and DPA-LGPD.
LIABILITY/TERMINATION
Cap 3 months; no indirect damages; termination for convenience (15 days) or breach (5 days).
LAW/CONTROVERSIES
B2B: CAM-CCBC arbitration (São Paulo), confidential; yes consumption, CDC/consumer forum.
